1. About This Agreement
This End User License Agreement ("EULA") is a legal agreement between you and Szilárd Szlákó
This EULA agreement governs your acquisition and use of Polyraven Vision ("Software") directly from Szilárd Szlákó or indirectly through an authorized reseller or distributor (a "Reseller").
This EULA agreement shall apply only to the Software supplied by Szilárd Szlákó herewith regardless of whether other software is referred to or described herein. The terms also apply to any updates, supplements, Internet-based services, and support services for the Software.
Szilárd Szlákó reserves the right to make changes to this EULA at any time by posting the changed Agreement at https://www.polyraven.com/vision-eula/ . Szilárd Szlákó is obligated to also provide notice by sending an email to any address you may have used to register for the Software, or through other similar mechanisms.
-"POLYRAVEN NETWORK" means web services used and/or operated by Szilárd Szlákó
IMPORTANT - DO NOT SKIP: BY DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU REPRESENT THAT YOU PURCHASED OR OTHERWISE ACQUIRED THE SOFTWARE FROM AN APPROVED SOURCE AND YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU ARE ACCEPTING THESE TERMS ON BEHALF OF ANOTHER PERSON, COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE FULL AUTHORITY TO BIND THAT PERSON, COMAPNY OR LEGAL ENTITY TO THESE TERMS.
IF YOU DO NOT AGREE TO THESE TERMS DO NOT DONWLOAD, INSTALL, COPY, ACCESS OR USE THE SOFTWARE.
2. Grant of License to Use the Software
2.1 Basic License Grant
If you aquired A Basic License, Szilárd Szlákó hereby grants you a personal, non-transferable, non-exclusive licence to use a limited version of the Polyraven Vision software on your devices in accordance with the terms of this EULA agreement. The software must be installed on a device and cannot be placed on a server accessed by multiple users.
You are permitted to load the Polyraven Vision software to devices (for example a PC, laptop, mobile or tablet) under your control.
You are responsible for ensuring your device meets the minimum requirements of Polyraven Vision.
Szilárd Szlákó is under no obligation to provide technical support under the terms of this license, and provides no assurance that any specific errors or discrepancies in the SOFTWARE will be corrected.
You are not permitted to do any of the things listed in section 2.4
2.2 Pro License Grant
If you aquired A Basic License, Szilárd Szlákó hereby grants you a personal, non-transferable, non-exclusive licence to use the Polyraven Vision software on your devices in accordance with the terms of this EULA agreement. The software must be installed on a device and cannot be placed on a server accessed by multiple users.
You are permitted to load the Polyraven Vision software to devices (for example a PC, laptop, mobile or tablet) under your control.
You are responsible for ensuring your device meets the minimum requirements of Polyraven Vision.
You are not permitted to do any of the things listed in section 2.4
2.3 Studio License Grant
If you aquired a Studio License, Szilárd Szlákó hereby grants you unlimited use of the Polyraven Vision software on your devices in accordance with the terms of this EULA agreement.
The software can be placed on a server accessibble by unlimited numbers of users on site.
A site is defined as a company, studio, building or campus within a single Postal Code Area.
You are responsible for ensuring your devices meets the minimum requirements of Polyraven Vision.
You are not permitted to do any of the things listed in section 2.4
2.4 License Limiatitons
You are not permitted to...
- Combine or incorporate parts or whole in any other software
- decompile, disassemble or reverse engineer the Software or attempt to do any such things
- remove any titles, trademarks or trade names, or other proprietary markings in or on the Software
- Reproduce, copy, distribute, resell the Software
- Allow any third party to use the Software on behalf of or for the benefit of any third party
- Use the Software in any way which breaches any applicable local, national or international law
3. Intellectual Property and Ownership
Szilárd Szlákó shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you.
The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of Szilárd Szlákó.
Szilárd Szlákó reserves the right to grant licences to use the Software to third parties.
4. Warranty
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
5. Termination
This EULA agreement is effective from the date you first download the Software and shall continue until terminated. You may terminate it at any time upon written notice to Szilárd Szlákó.
It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.
6. Updates and Automatic Communications
The SOFTWARE has built in functionality to automatically check for updates by transmitting data to servers of POLYRAVEN NETWORK. You agree that the SOFTWARE may transfer such data over your network and the internet to POLYRAVEN NETWORK's servers, download updates and install them as part of the SOFTWARE.
The SOFTWARE may communicate with POLYRAVEN NETWORK to help determine the number and geolocation of active copies of the SOFTWARE. Szilárd Szlákó garantees that only the minimum ammount of required data is transfered, and no personal data is used in the process.
7. Governing Law
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of Czech Republic.
